Juan Francisco Mendez, 29, was apprehended on a routine day, alongside his wife, Marilu Domingo Ortiz, who shared her harrowing experience of being forcibly removed from their vehicle on Tallman Street.

As they sat in their car, waiting for their attorney—who had advised them not to answer questions without her present—agents demanded they lower their window. When they did not comply, the agents escalated the situation, threatening to break the window. “If you’re not coming out the right way, you’re gonna come out,” Ortiz recounted, a chilling reminder of the aggressive tactics sometimes employed in immigration enforcement. Their ordeal culminated in the use of a sledgehammer to smash the window and extract them from the vehicle, a scene that Ortiz captured on her cellphone.

The incident has drawn significant criticism from immigration advocates and legal experts. Ondine Galvez Sniffin, an immigration attorney, condemned the use of such excessive force, stating that agents “grabbed the husband from behind to keep him from holding onto the front door” and forcibly dragged both him and his wife out of the car. “There was no need for them to use that level of physical force. It was completely unjustified,” she asserted, underscoring a growing concern over the methods employed by immigration enforcement under the current administration.

Ortiz revealed that the agents were allegedly searching for another individual named Antonio, suggesting a possible case of mistaken identity. This raises important questions about the protocols in place for identifying and apprehending individuals in immigration cases, especially when innocent parties are put at risk. Mendez is currently in the process of seeking legal status in the U.S. and, significantly, has no criminal record. His family, which includes their 9-year-old son, already has legal status, further complicating the rationale behind the arrest.

Senator Ed Markey described the situation as emblematic of a broader crisis, stating, “it’s a very troubling time where the Constitution, due process, the law, is under assault.” Governor Maura Healey echoed these sentiments, emphasizing that while law enforcement must apprehend individuals who pose a threat, the approach taken in this case—smashing a car window and forcibly removing a family—was not only excessive but also counterproductive to public safety.

In response to the outcry, ICE issued a statement defending the actions of the agents, claiming that Mendez “refused to comply with officers’ instructions and resisted apprehension.” They maintained that their officers are trained to use the minimum amount of force necessary to resolve situations. This defense, however, does little to assuage the fears of many who view such enforcement actions as indicative of a system that is increasingly prioritizing aggressive tactics over the dignity and rights of individuals.

The town of New Bedford does not operate as a sanctuary city and has a working relationship with federal immigration agents. Mayor Jon Mitchell confirmed that the city had been notified about the arrest but expressed a need for clarity on the reasons behind such actions. “We need to know if they’re picking up somebody who should be prioritized, and why they’re doing what they’re doing,” he remarked, underscoring the importance of transparency in immigration enforcement.
