On November 27, 2023, Robert Cary McNair Jr. filed an application for guardianship of his mother’s person and estate. However, both Janice McNair and her other son, Cal McNair, are opposing the application. Cal McNair, who serves as the chairman and CEO of the Houston Texans, is standing by his mother’s side in this legal battle.

During a recent hearing, the McNair family’s lawyers were discussing whether the records related to the probate case should be sealed. Janice McNair submitted an affidavit to the court in December, stating that Cary McNair was attempting to limit or terminate her rights and take control of her estate. She also accused him of using his position as a fiduciary in the family’s companies to gain access to confidential financial and personal information.

Janice McNair has requested that the records be sealed, referring to the case as a “family dispute” and expressing concerns about the negative impact it could have on the Texans if more details were made public. She wrote that it would create unnecessary media attention and potentially harm the team, its employees, and business partners.

Cal McNair echoed his mother’s sentiments in his own affidavit, emphasizing the negative consequences that the proceedings could have on the Texans. In response to these concerns, Judge Jerry Simoneaux issued a temporary sealing order in December.

Janice McNair became the principal owner of the Houston Texans following the death of her husband in 2018. As the legal battle unfolds, the family feud threatens to overshadow the team’s success on the field. The outcome of this court case will undoubtedly have significant implications for both the McNair family and the future of the Houston Texans.
