Since the incident, Aguilar’s girlfriend has denied the allegations both to ABC13 and in an affidavit filed in Galveston County. This denial has been pointed out by Aguilar’s defense attorney, Mark Diaz. The suspension order will remain in effect until Aguilar’s charge is dismissed or until he is acquitted.

This recent development has cast doubt on Aguilar’s ability to preside over family violence cases. Prosecutors have requested him to recuse himself in seven such cases, but Aguilar has denied the motions and referred the requests to an administrative judge. Amanda Cain, the Communications Director for the Administrative Office of the District Courts, released a statement addressing the situation. She stated that efforts are being made to ensure that court operations remain uninterrupted despite Aguilar’s suspension. This is not the first time that Aguilar has faced assault allegations. In 2010, while serving as a Harris County Magistrate, he was found not guilty of assaulting a previous girlfriend. With this history, questions are being raised about Aguilar’s fitness for the position of a judge.
