Former Mass General Hospital Medical Assistant Charged with Indecent Assault and Battery

Unwanted Examination at Mass General Hospital Leads to Charges of Indecent Assault and Battery

A former medical assistant at Massachusetts General Hospital (MGH), Leonardo Hernandez, has been charged with indecent assault and battery after allegedly conducting an unauthorized examination on a patient. The incident occurred earlier this year and was brought to the attention of Boston police on April 12 when the patient filed a report with the MGH dermatology unit.

According to the Suffolk County District Attorney’s office, the incident took place when the patient was receiving care at the unit. As her physician left the room, there was a knock on the door followed by a man’s voice. The patient recognized the man as Hernandez, who had seen her during previous appointments. Hernandez entered the examination room and offered to conduct a skin examination on her foot due to a possible condition.

The patient, unaware of any additional examination, assumed that her doctor had requested it and consented. However, during the examination, Hernandez repeatedly asked to see her breast. At one point, he even attempted to pull down her hospital gown. Disturbed by his actions, the patient refused his requests, leading Hernandez to finally leave the room.

The next day, the patient inquired with her doctor about any follow-up examinations that had been ordered. The doctor confirmed that she hadn’t requested any additional exams and clarified that such an examination was not within Hernandez’s job description.

Following the investigation, Hernandez was arraigned on charges of indecent assault and battery and released on personal recognizance. He is scheduled for a pre-trial hearing on July 24.

In response to the allegations, MGH promptly terminated Hernandez’s employment and assisted the patient in contacting the authorities. A spokesperson for MGH emphasized their commitment to ensuring high-quality and reliable care in a safe healthcare environment. They expressed deep concern over the allegations and praised the patient for coming forward to expose Hernandez’s alleged conduct. MGH also stated that they had fully cooperated with the law enforcement investigation.

This incident raises important questions about patient safety and the need for vigilance in healthcare settings. Patients should be aware of their rights and feel empowered to speak up if they encounter any inappropriate behavior. Medical institutions must prioritize patient well-being and take swift action when incidents like these occur.

Unfortunately, cases of medical professionals abusing their positions of trust are not unheard of. The healthcare industry must continue to implement robust protocols and training to prevent such incidents and provide comprehensive support to victims. By creating a culture of transparency and accountability, medical institutions can foster an environment where patients feel safe and protected.

It is crucial for patients to report any instances of misconduct or inappropriate behavior. Their courage in coming forward helps to expose wrongdoing and protect others from potential harm. This case serves as a reminder that no one should tolerate or remain silent about any form of abuse, especially in a healthcare setting where vulnerability is heightened.

The legal process will determine the outcome of the charges against Hernandez. However, this incident serves as a stark reminder for both medical professionals and patients about the importance of upholding ethical standards and maintaining a respectful and safe environment within healthcare facilities.
