The incident took place around 10 p.m. near Chrystie and Grand streets in the Lower East Side. Surveillance video captured the scuffle between the landlord and the homeless man. The footage shows the homeless man swinging his makeshift club at Chin, who retaliates by knocking him to the ground and repeatedly punching him in the head. Chin also appears to kick the man while he is lying on the ground.

Prior to the altercation, the homeless man had broken a wooden chair and was menacingly wielding a piece of the wood at Chin. The makeshift club had a nail at the tip, adding to the danger of the situation. The video evidence clearly depicts the homeless man swinging the weapon at Chin before the landlord charges at him.

The seriousness of the homeless man’s injuries cannot be understated. After being rushed to Bellevue Hospital, he had to be intubated. The extent of his injuries and the traumatizing nature of the attack highlight the severity of the incident.

However, it is important to note that another video taken before the chair-breaking incident shows Chin approaching the man and kicking him while he is already on the ground. This incident occurred just a year after one of Chin’s tenants, Christina Yuna Lee, was brutally stabbed to death in her own kitchen by a random assailant. Chin, who spoke out against crime after Lee’s murder, expressed his frustration with the attacks on the Asian community. It is possible that this traumatic event has had a lasting impact on Chin’s mental state, contributing to his response in the recent altercation.

Brian Chin was released on his own recognizance and is scheduled to appear in court on October 10th.
