Brazil’s Supreme Federal Court recently upheld a ban and fines on Elon Musk’s social media platform, X, after it failed to comply with local regulations. The court ruled in favor of Justice Alexandre de Moraes, who shut down the platform for not adhering to the court’s requirements. Justices Flavio Dino and Cristiano Zanin sided with de Moraes, forming a majority before Justices Luiz Fux and Carmen Lucia cast their votes.

The feud between Moraes and Musk began when X was asked to block accounts involved in spreading distorted news and hate speech. Dino expressed his support for Moraes, stating that a company cannot operate in a country and impose its own rules. He criticized X for intentionally failing to comply with court decisions, suggesting that it views itself as above the rule of law.

X was taken down in Brazil, one of its largest markets, on August 31st, after missing a court-imposed deadline to name a legal representative in the country. De Moraes issued a shutdown order, stating that X must comply with the court’s requirements before it can resume operations. He also imposed a daily fine of $8,900 for individuals or firms attempting to circumvent the ban.

Musk responded to the situation by posting multiple criticisms of de Moraes on X, calling for his impeachment and accusing him of violating his oath of office. However, some critics argue that the ban and fines are excessive. Professor Maurício Santoro expressed his concerns, comparing the situation to authoritarian countries like China.

The Brazilian Bar Association has also expressed its opposition to the fines imposed on citizens using VPNs or other means to access X. They argue that sanctions should only be imposed after an adversarial process and the right to a full defense. Despite criticism, Brazilian President Luiz Inácio Lula da Silva and Supreme Court Chief Justice Luís Roberto Barroso have publicly supported de Moraes’s decision.

The ban officially took effect on August 31st, and attempts to access X through a VPN were unsuccessful. X has a significant user base in Brazil, with tens of millions of users. Some users have indicated that they are migrating to alternative platforms such as BlueSky and Threads.

Jay Graber, CEO of BlueSky, which was co-founded by Twitter’s Jack Dorsey, reported a significant increase in traffic on their platform. However, Graber warned users about potential slow loading times due to the surge in traffic.
