In 1980, Depoian and her husband sought Dr. Berger’s help at his Dedham office to conceive a child. They were informed that they would receive sperm from a medical resident. However, according to the lawsuit, Dr. Berger used his own sperm instead.

A Daughter’s Struggle

Sarah Depoian gave birth to her daughter, Carolyn, in 1981. Carolyn, now speaking out about the allegations, revealed the emotional impact of Dr. Berger’s actions on her and her family. She expressed that she will always struggle with what he did to her mother and their lives.

Carolyn discovered the truth through a home DNA test earlier this year, which revealed a biological connection to Dr. Berger’s granddaughter and second cousin. Although the test did not provide a direct match for her biological father, Carolyn identified two relatives who were related to Dr. Berger. Through conversations with one of these relatives, she began piecing together the truth.

Response from Boston IVF

Berger, now retired, was a founder of Boston IVF, a fertility clinic with locations nationwide. In response to the lawsuit, Boston IVF released a statement emphasizing that the alleged incident occurred more than 40 years ago, before Dr. Berger’s employment at the clinic and before the company even existed. The statement also highlighted the significant advancements in safety measures and safeguards in the field of reproductive endocrinology and infertility over the years.

Legal Battle Ahead

Dr. Berger’s attorney issued a statement dismissing the allegations as having no legal or factual merit. The attorney is confident that the claims will be disproven in court. Sarah Depoian’s lawsuit has been filed in federal court, and there is a possibility of a second lawsuit being filed on behalf of Carolyn Bester.
