Harvey Weinstein Faces New Indictment on Additional Sex Offenses

Harvey Weinstein, the former movie mogul, is set to face new charges as he is expected to be arraigned in Manhattan on Wednesday. His lawyer, Arthur Aidala, confirmed that Weinstein will appear in court in person after missing a hearing last week due to emergency heart surgery. The Manhattan District Attorney’s office revealed during the previous hearing that a grand jury had issued a new indictment, charging Weinstein with previously uncharged offenses. The details of the indictment will remain sealed until Weinstein’s arraignment. Prosecutors have stated that the grand jury heard evidence of up to three alleged assaults, which took place at various locations, including the Tribeca Grand Hotel and a Lower Manhattan residential building in the mid-2000s, as well as a Tribeca hotel in May 2016.

In addition to these new charges, Weinstein is also awaiting retrial in his landmark #MeToo case. Earlier this year, New York’s highest court overturned his 2020 conviction, leading to the scheduling of a retrial set to begin on November 12. Prosecutors have expressed their intention to include the new charges in the retrial, but Weinstein’s legal team opposes this, arguing that it should be treated as a separate case.

Aidala expressed uncertainty regarding the details of the new charges, as the sealed indictment only provides limited information. He stated that they are unaware of the exact accusations, locations, and timing related to the additional allegations presented to the grand jury. Weinstein has consistently maintained that any sexual activity was consensual.

Weinstein has been under medical care since September 9, when he underwent emergency surgery to drain fluid around his heart and lungs. Last week, a judge ruled that he could remain in the prison ward at Bellevue Hospital indefinitely, instead of being transferred back to the infirmary ward at Rikers Island jail complex.

Earlier this year, New York’s Court of Appeals vacated Weinstein’s conviction and ordered a new trial. The court ruled that the trial judge had allowed testimony against Weinstein based on allegations from other women that were not directly related to the case.

Once a powerful figure in Hollywood, Weinstein co-founded Miramax and The Weinstein Company, producing acclaimed films such as “Shakespeare in Love” and “The Crying Game.” However, his reputation and career have been marred by the numerous sexual misconduct allegations that triggered the #MeToo movement.
