Demonstrator Faces Charges for Shooting Incident at Pro-Israel Protest

A pro-Israel protest in Newton turned violent when a demonstrator allegedly shot a man, leading to the arrest of Scott Hayes. The incident occurred at the intersection of Washington Street and Harvard Street on Thursday evening. According to Newton Police Chief David Ryan, a confrontation ensued between a group of pro-Israel protesters and a man on the opposite side of the street. The man repeatedly stepped into the road, escalating tensions. Eventually, he charged across the street and tackled Hayes, resulting in a scuffle during which Hayes shot the man. The victim, identified as Caleb Gannon, sustained life-threatening injuries.

Hayes appeared in court on Friday, where a not guilty plea was entered on his behalf. The judge set his bail at $5,000. Despite visible scratches on his arms and face, Hayes maintained that he acted in self-defense. However, prosecutors argued that there was sufficient evidence to charge Gannon in connection with the incident. The charges against Hayes included assault and battery with a dangerous weapon, while the initial charge of violation of a constitutional right causing injury was dropped.

Outside Newton District Court, supporters of Hayes gathered, expressing their belief in his innocence. David Sherman, a witness to the incident, claimed that the other man charged at Hayes with his fists raised and tackled him. Sherman and others intervened to separate the two individuals and treat Gannon’s gunshot wound, which was located in his stomach. The supporters contend that Hayes was defending himself and should not have been arrested.

Newton Mayor Ruthanne Fuller, Chief Ryan, and Acting Police Chief George McMains emphasized that the investigation was ongoing and urged the community to remain calm. They encouraged anyone with video footage of the incident to come forward and assist in the investigation. The Anti-Defamation League (ADL) also expressed concern over the charges being filed before the completion of the investigation, emphasizing that protests should not result in violence. The ADL called for a thorough investigation and expressed worry about escalating tensions.

US Representative Jake Auchincloss, a former Newton city councilor, condemned the violence and expressed gratitude for the swift response by law enforcement and emergency medical personnel. He called for a thorough investigation by Newton police and the district attorney’s office.

A GoFundMe campaign in support of Hayes has already raised over $124,000. His legal team expects him to post bail soon after his arraignment. If released, Hayes will be required to wear a GPS monitor and adhere to several restrictions, including a curfew. He will also be prohibited from returning to Newton and possessing any weapons. Hayes is scheduled to appear in court again on November 7.
